Scott Baker has represented businesses of all sizes, other entities, and individuals in cases involving a wide array of civil and commercial litigation matters. Recognized by Texas Monthly as a 2007 “Rising Star” in general litigation, Mr. Baker has thirteen years of experience representing clients through the pre-trial, trial, and appellate processes, and he has extensive experience resolving his clients’ complex disputes through negotiation and mediation.

Mr. Baker has litigated and resolved many commercial litigation matters, including disputes between partners and shareholders, derivative shareholder claims, billing disputes, and breach of contract cases involving a wide variety of matters. Mr. Baker has extensive experience successfully presenting his clients’ cases through written advocacy.

Since graduating from The University of Texas School of Law in 1995, some of Mr. Baker’s representative experience includes the following: he obtained summary judgments and other dispositive orders in favor of his clients in matters such as a will contest, an oil and gas case, employment disputes, and a personal injury case in which a plaintiff sued his client for several million dollars. He obtained an injunction against the Texas Comptroller to enjoin a sales tax policy, and he has negotiated resolutions to other cases involving sales and franchise taxes. He negotiated and obtained a significant settlement on behalf of a real estate development company that sued to enforce its rights to purchase a large commercial lot, and he has successfully negotiated resolutions to other commercial purchase and lease disputes. Mr. Baker has extensive experience with probate, trust, and other fiduciary litigation—he has negotiated favorable resolutions to a will contest, a suit against a charitable foundation, and claims against trustees. He has represented clients in matters involving the First Amendment and religion, including the defense of a religious entity in misconduct claims against it. Mr. Baker has experience representing clients in administrative matters, including the favorable resolution of a state agency’s claims seeking significant administrative penalties against his client. He prepared the trial and appellate court briefs to successfully challenge a Texas court’s jurisdiction over a major trade association, and he prepared the successful brief to obtain an injunction under the Americans with Disabilities Act in favor of a disabled golfer who sought to qualify for the U.S. Senior Open.
